The Honorable William Barr

Attorney General

Department of Justice

950 Pennsylvania Avenue, NW

Washington D.C. 20004

Dear Attorney General Barr:

I write to you regarding reports that Huawei Technologies Co., Ltd., has sued the Federal Communications Commission (FCC) over the decision to block carriers in the United States from using federal funds to purchase Huawei equipment.

President Donald Trump and the Department of Commerce correctly determined that Huawei and its affiliates are a national security threat to the United States, our allies, and our privacy. To protect the American people, the Administration added Huawei and its affiliates to the Entity List maintained by the U.S. Department of Commerce’s Bureau of Industry and Security.

Huawei is aiding the Communist Regime in Beijing. Like many Chinese companies that the Communist Party considers national champions, they are heavily subsidized by the state.  Huawei's president and founder, Ren Zhengfei, is a former engineer for the People's Liberation Army and a member of the Chinese Communist Party. The tech that Huawei manufactures gives them access to data and information that would be invaluable to Communist China’s efforts to influence governments all over the world. Huawei is being used as a tool for Communist China to commit espionage on foreign nations, their own citizens and anyone they see as a threat.

The United States is right to keep Huawei out of our markets. Huawei is being run by Communist China, who continues to violate human rights, steal our information and intellectual property, and build up their military to compete with us. We cannot allow foreign state-owned enterprises to operate in the United States if they violate our laws and steal our information to use against us. The challenge by Huawei is of the utmost concern to our national security, and I urge you to bring immediate attention to the case. As you recently stated in a letter to the FCC, “as the world decides where to place its trust, we should not signal that Huawei and ZTE are anything other than a threat to our collective security.” I agree with you wholeheartedly, and I look forward to continuing to work to protect the security of the American people.

Sincerely,

Rick Scott

United States Senator
